§ 42-29. Placing garbage and trash cans for collection.

  • (a)

    It shall be unlawful for any sanitary trash containers, trash cans, or any other type of refuse containers or refuse holders to be exposed to view of the general public on street frontages of any residence, commercial structure, or institution, except on days of scheduled regular garbage pickup between the hours of 6:00 a.m. and 9:00 p.m., unless city pickup service is impaired. Multifamily residences are authorized front street collection storage points which conceal the contents.

    (b)

    If the house, building, or premises from which the garbage and trash is to be collected and removed is adjacent to an alley, the owner, occupant, or lessee of such premises shall be required to place the containers adjacent to the alley for collection, at such times and in such manner as the city official designated by the city council or city secretary may direct.

    (c)

    In the event it is not practicable to collect and remove garbage and trash from an alley, or if there is no alley adjacent to the premises, the owner, occupant, tenant, or lessee of the premises shall place the container for collection at the front of the property and adjacent to the curb or street.

    (d)

    In no event shall the collector be required to enter buildings, garages, breezeways, carports, fences or other structures to make collections. In the event it is not practical to place the containers for collection as specified in this section, the city official designated by the city council and/or the city secretary shall determine the location of the containers.

    (e)

    As soon after the garbage and trash has been removed by the collector as is practicable, the owner, occupant or lessee shall remove the container or containers from the curb, street line or alleyway to a place within the premises until the next regular scheduled time for collection.
