§ 28-41. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meaning defined as follows, except where the context clearly indicates a different meaning:

    Building official means the city manager or her designated representative of the city.

    Certificate of occupancy means a certificate issued by the building official for the use of industrialized housing when it is determined by such officer that such housing complies with the provisions of the city's Code of Ordinances and regulations and applicable state law.

    City means the City of George West.

    City council means the City Council of the City of George West, Texas.

    City limits means the corporate limits of the city.

    Family, as defined for the purposes of R-1 and R-2 zones, means any number of individuals living in industrialized housing which are related by blood, marriage, or adoption, or up to and including three unrelated individuals.

    Industrialized housing means a residential structure:

    (1)

    Designed for the occupancy of one or more families;

    (2)

    That is constructed in one or more modules or constructed using one or more modular components built at a location other than the permanent site;

    (3)

    Designed to be used as a permanent residential structure when the module or the modular component is transported to the permanent site and erected or installed on a permanent foundation system; and

    (4)

    Is commonly referred to as modular homes.

    "Industrialized housing" does not include:

    (5)

    A residential structure that exceeds three stories or 49 feet in height as measured from the finished grade elevation at the building entrance to the peak of the roof;

    (6)

    A residential structure constructed of sectional or panelized system that does not use a modular component;

    (7)

    A ready-built home constructed in which the entire living area contained in a single unit or section at a temporary location for the purpose of selling and moving the home to another location;

    (8)

    A HUD-code manufactured home, not a mobile home, recreational vehicle.

    Label means a seal or insignia issued by the Texas Commission of Licensing and Regulation to indicate compliance with the standards, rule and regulations.

    Owner means the person in whose name the title to the industrialized housing, lot, block, tract or parcel of land is shown to be.

    Permit means a written permit issued by the city authorizing a person to place an industrialized housing in the city under the provisions of this article.

    Permittee means any person licensed to place the industrialized housing in the city under the provisions of this article.

    Person means an individual, person, partnership, firm, company, corporation, association, tenant, owner, lessee, or licensee, their agents, heirs or assigns.

    Planning and zoning commission means the Planning and Zoning Commission of the City of George West.

    Replacement means the act of moving one industrialized housing from its existing site and replacing it with another industrialized housing with seal.

    Seal means a device or insignia issued by the Texas Commission of Licensing and Regulation to be affixed to the industrialized housing for titling purposes.

    Site means a plot of ground upon which a modular home is placed; this term also shall include the term "lot."

    Value means the taxable value of the industrialized housing and the lot after installation of the housing.
